The incident occurred in 2021 when the child was two years old. The mother, Madison Ball, says she trusted her then-husband, Charles Brooks Jr., to babysit her son.
Ball alleges Brooks told her he had to visit his grandfather in a Dallas hospital and took the child with him. She later learned he had not gone to a hospital, she said.
During a FaceTime call, Ball says she saw her son barely breathing. Brooks allegedly claimed the boy had fallen and had been revived in an ice bath.
At the hospital, medical staff found a severe brain bleed, traumatic brain injury, adult bite marks, and multiple organ and neurological damage. The child spent months in the ICU in a medically induced coma.
He is now seven, permanently disabled, confined to a bed, dependent on a breathing machine, and requires round-the-clock care. The lawsuit states the injuries will require lifelong medical support.
Criminal case and capture
Brooks was arrested 11 days after the 2021 incident. He later fled before being recaptured.
In 2023, Brooks pleaded guilty to injury to a child. Court records show he received a 40-year prison sentence.

The family filed a civil lawsuit seeking compensatory and punitive damages. Their attorneys argued Brooks acted with reckless and egregious conduct.
