A Victorian nursing home has been penalized following a tragic outbreak of COVID-19 that resulted in the deaths of 45 residents. St Basil’s Home for the Aged has been convicted and fined after the court ruling on the one of the most devastating nursing home incidents during the pandemic.

Nursing Home Outbreak Details

During July 2020, St Basil’s, located in Fawkner, Melbourne, experienced a severe COVID-19 outbreak. Out of the 92 residents, almost half succumbed to complications related to the virus within just a month.

Court Conviction and Penalty

Judge Trevor Wraight of the Victorian County Court imposed a fine of $150,000 on St Basil’s for breaches in workplace health and safety regulations. The court found that the facility had failed to implement necessary COVID-19 safety measures despite being aware of the outbreak.

Health and Safety Compliance

Although the nursing home engaged external medical professionals to conduct training across five sessions, it did not ensure that all staff members received this important instruction.

Future Considerations

Judge Wraight noted the lengthy duration of the criminal proceedings, which spanned over five years, and the significant media coverage as factors in his sentencing. He also recognized that St Basil’s has improved its safety protocols in anticipation of future health crises.

The maximum penalty for the aged care home could have reached $1.4 million. A separate coroner’s investigation into the resident deaths remains ongoing but has been paused pending the conclusion of the criminal case.
