Will Smith Seeks Dismissal of Violinist’s Sexual Harassment Lawsuit
Will Smith is seeking the dismissal of a sexual harassment lawsuit filed by his former tour violinist, Brian King Joseph. The lawsuit claims that Smith groomed Joseph for sexual exploitation during the Based on a True Story Tour.
Allegations Against Will Smith
Brian King Joseph alleges that his personal belongings were missing from his hotel room for several hours. These items were returned with a note featuring a heart and the message, “Brian, I’ll be back…just us.” Joseph interpreted this as a threat of sexual assault.
Legal Action and Defense
On February 20, Smith and Treyball Studios Management filed a motion in the Superior Court of Los Angeles. They requested the court to dismiss the lawsuit, labeling it as “false and defamatory.”
- Joseph is described as targeting Smith with what the defense calls a “frivolous lawsuit.”
- Smith’s attorneys labeled the allegations as “untrue, inflammatory, and legally baseless.”
- The defense claims Joseph’s underperformance led to his removal from the tour, a decision not made by Smith.
Smith’s attorneys argue that there is insufficient evidence backing Joseph’s claims. They assert that Joseph was never guaranteed a permanent position in the band and was eventually deemed not a good fit for the tour.
Response from Brian King Joseph’s Legal Team
Joseph’s attorney, Jonathan J. Delshad, expressed intentions to contest Smith’s motion. He confirmed plans to present compelling facts in court to support Joseph’s accusations.
Upcoming Hearing
A court hearing regarding this case is scheduled for April 28, 2026. Both parties will have the opportunity to present their arguments and evidence.
