Activewear brand Lululemon has faced significant penalties for violating spam regulations in Australia. The Australian Communications and Media Authority (ACMA) has imposed a fine of $702,900 after Lululemon sent over 370,000 emails without providing an option for recipients to unsubscribe.

Lululemon’s Spam Violation Details

The ACMA’s investigation revealed that between December 2024 and January 2025, Lululemon mischaracterized service messages. These included delivery and order confirmation emails that also contained marketing content. According to authority member Samantha Yorke, every marketing message must include an unsubscribe option.

Company’s Response

A spokesperson for Lululemon stated that the company is dedicated to providing a compliant guest experience. They announced intentions to conduct an independent review of their spam compliance measures. They emphasized cooperating with the ACMA to rectify the issue.

The ACMA highlighted that since August 2024, several companies, including Lululemon, have incurred over $14 million in penalties for similar spam violations.

As part of the enforcement, Lululemon agreed to a comprehensive court-enforceable commitment to improve its compliance with spam rules. The company will regularly report to the ACMA regarding the implementation of the recommended changes.
