Brett Gardner’s Family Sues Costa Rica Resort Over Son’s Carbon Monoxide Death
Former Yankees outfielder Brett Gardner and his family filed a lawsuit against the Arenas Del Mar resort in Costa Rica. The complaint was filed nearly one year after the death of their 14-year-old son, Miller Gardner.

Incident details
Miller Gardner died on March 21, 2025, at the resort. Officials later ruled carbon monoxide poisoning as the cause on April 3, 2025.
All four family members became violently ill overnight. Miller suffered severe vomiting and paralysis, losing use of his arms and legs.
His wife, Jessica, experienced nausea, disorientation and hallucinations. She also suffered a head cut and has no memory of how it occurred.
Their older son, Hunter, went outside for fresh air and survived. He had difficulty moving his arms and legs before he left the room.
A blood test showed Miller’s carboxyhemoglobin saturation at 64 percent. Levels above 50 percent are considered lethal.
Investigators found no carbon monoxide monitors in the mechanical room or guest rooms. The absence of detectors is cited in the legal filing.
Allegations and claims
The lawsuit accuses the resort of failing to meet basic safety standards. It contends the mechanical room and its equipment caused increased carbon monoxide levels.
The family seeks damages for gross negligence, wrongful death and emotional distress. They also cite vicarious liability, breach of warranty, and loss of filial consortium.
Motley Rice litigator Michael Elsner said the owners and managers failed in their duty of care. He said documents show prior warnings and unimplemented safety fixes.
Investigations and responses
Costa Rican authorities raided the resort in September. That was the first formal search since Miller’s death.
As of that raid, the death remained under investigation. A resort spokesperson did not immediately respond to requests for comment.
Costa Rica officials also did not immediately reply to inquiries. The legal process and the criminal investigation continue separately.

Gardner said the year since the death has been excruciating for the family. They hope the lawsuit will raise awareness and prevent similar tragedies.
